Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") form a binding agreement between you ("you", "your", "User") and Mazcom ("Mazcom", "we", "us", "our") and govern your access to and use of the Mazcom mobile application, the website at mazcom.com.ng, and all related communication, calling, wallet, DID (Direct Inward Dialing) number, and agent services (together, the "Services").
By creating an account, ticking the acceptance box at registration, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not create an account or use the Services.
2. Definitions
- "Services" means the voice-over-IP calling, messaging, wallet, DID, airtime, and related features we provide.
- "Minutes" means prepaid call credit measured in seconds that is consumed when you place billable calls.
- "Wallet" means the prepaid balance in your account used to purchase Minutes, DIDs, and other paid features.
- "DID" means a telephone number assigned to your account for receiving calls.
- "Agent" means an account permitted to create and fund customer accounts and resell Services through the agent portal.
- "Content" means any text, audio, contact data, or other material submitted through the Services.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.
4. Account Registration and Security
- You must provide a valid name, email address, phone number, and password when registering.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must notify us immediately at support@mazcom.com.ng of any unauthorised use or suspected security breach.
- One person or organisation per account. Accounts are personal and, except for approved Agent accounts, may not be shared, sold, or transferred.
- We may require identity verification (see Section 9) before enabling certain features, numbers, or call destinations.
5. The Services
Subject to these Terms and your available balance, we provide:
- Voice calling — app-to-app and outbound calls to public telephone networks. App-to-app calls between Mazcom users are free; calls to external numbers are billed per minute from your Minutes balance at the rate shown in the app before you call.
- DID numbers — inbound numbers that may be assigned to your account, subject to availability, verification, and payment.
- Wallet and Minutes — top-ups used to purchase Minutes and other features. Purchased Minutes generally do not expire while your account remains active, unless stated otherwise at the time of purchase.
- Support — in-app support chat and email assistance.
- Agent programme — for approved agents only, tools to create and fund customer accounts, purchase DIDs, and manage balances.
Call quality, completion, and uptime depend on factors outside our reasonable control, including your internet connection, the recipient's network, and interconnecting carriers.
6. Charges, Wallet, and Payment
- All prices are displayed in Nigerian Naira (₦) and are inclusive of applicable taxes unless stated otherwise.
- You must fund your Wallet before purchasing Minutes or other paid features. Calls are billed in increments of seconds based on the applicable rate.
- Where a call is billed but not connected, or where the Services fail through our fault, we may, at our discretion, adjust your balance.
- Except where required by law or expressly stated, payments and top-ups are non-refundable. Minutes and Wallet balances are not redeemable for cash and are not transferable except through approved Agent tools.
- Payments are processed by third-party payment providers. You are also subject to their terms. We do not store full card details.
- We may change rates, packages, and fees at any time. Changes take effect when published in the app or on the website and do not affect calls already in progress.
7. Call Recording and Consent
Some calls may be recorded where the feature is enabled and where permitted by applicable law. You are solely responsible for complying with all laws on call recording in your jurisdiction and the jurisdiction of the other party, including obtaining any required consent. You must not use the Services to record a call where recording is unlawful.
8. Acceptable Use and Prohibited Conduct
You agree not to use the Services to:
- Engage in fraud, scams, phishing, or any deceptive or unlawful activity;
- Make nuisance, threatening, harassing, or unsolicited marketing or robocalls;
- Impersonate any person or misrepresent your identity or affiliation;
- Infringe intellectual property or privacy rights of others;
- Transmit malware, attempt to gain unauthorised access, or interfere with the Services or networks;
- Resell, sublicense, or commercially exploit the Services except as expressly permitted under an Agent agreement;
- Circumvent billing, use stolen payment instruments, or abuse promotions or chargebacks;
- Violate any applicable law, regulation, or the rules of any telecommunications or data-protection authority in Nigeria or elsewhere.
We may investigate and cooperate with law enforcement, and may suspend or terminate accounts that breach this section.
9. Identity Verification (KYC)
To comply with legal and regulatory obligations, we may require you to submit a National Identification Number (NIN) and proof of address before a DID is assigned or certain features are enabled. Verification documents are reviewed by our team and are handled in accordance with our Privacy Policy. We may decline, suspend, or revoke features where verification fails or cannot be completed.
10. Agent Terms
- Agents act as resellers and are responsible for the accuracy of customer information they submit and for complying with all applicable laws, including customer identification (KYC) and consent obligations.
- Agents fund customer accounts from their own Wallet. Agents may not resell access to the mobile app to end users and may be required to use only the agent portal.
- Agent pricing, commission, and any wholesale arrangements are governed by a separate agent agreement or the rates published in the agent portal. If there is a conflict, the agent agreement prevails.
- We may suspend agent privileges for misuse, chargebacks, fraud, or breach of these Terms.
11. Intellectual Property
The Services, including all software, trademarks, logos, and content we provide (excluding your own Content), are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law.
12. Third-Party Services
The Services rely on third parties, including payment processors, push-notification providers, telephony and network carriers, and hosting providers. Their acts and omissions are outside our control, and your use of third-party services may be subject to their own terms and policies.
13. Service Availability and Changes
We aim to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue all or part of the Services (including maintenance), and may set limits on use, at any time. We will use reasonable efforts to give notice of material changes.
14. Suspension and Termination
We may suspend or terminate your account if you breach these Terms, if required by law, or if we reasonably believe your account poses a risk of fraud or harm. You may stop using the Services at any time. On termination, your right to use the Services ends immediately and any remaining balances may be forfeited to the extent permitted by law. Sections that by their nature should survive termination will continue to apply.
15. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Services will meet your requirements or that calls will always connect or be uninterrupted.
16. Limitation of Liability
To the maximum extent permitted by law, Mazcom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Services shall not exceed the total amount you paid to us in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Nigerian law.
17. Indemnification
You agree to indemnify and hold harmless Mazcom, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your Content, or your breach of these Terms or applicable law.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. The parties shall first attempt to resolve any dispute amicably. Failing resolution, disputes shall be subject to the exclusive jurisdiction of the competent courts of Nigeria.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will revise the "Last updated" date and, where appropriate, notify you in the app. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
